Frequently Asked Questions

Is Pre-settlement lawsuit funding a “loan?”

No. Pre-settlement funding is not a “loan.” A loan is a monetary debt that must be re-paid. A pre-settlement lawsuit cash advance only has to be repaid IF and WHEN you win your case. If you don’t win your case, you don’t repay the advance. You keep it.

What if I have bad credit?

Your credit score plays absolutely no part in our determination. We don’t even ask for your credit score when we review your case for lawsuit funding. If you lose your case, you keep the advance. We don’t notify any credit agency. Your personal credit is not affected.

How much cash can I receive?

$500 is our minimum pre-settlement advance. $500,000 is our maximum.

How do you determine the amount of a lawsuit advance my particular case can receive?

As your attorney will likely tell you, each case is different. Despite what “your neighbor” told you about their settlement, your is different. What he or she got bears very little relation to what your case is worth. We examine many factors, a few of which are:

  • How strong is the liability of the defendant?
  • What are your injuries
  • How much are your medical bills and lost wages?
  • Does the defendant have liability insurance?
  • What are the policy limits of the defendant’s insurance?
  • What available insurance do you have?
  • Are there other liens already against your case?
  • In what state and jurisdiction did the accident happen?

Is there anything I can do to enhance my chances of getting a pre-settlement advance?

Yes, be honest. That’s the only thing. The facts of your case are what they are. If we find at any time you are dishonest with us or your attorney we will withdraw from the funding process and deny your application.

Will you contact my attorney or do I have to?

We will contact your attorney. All you need to do is make sure we have a good contact name and number, and the name of the paralegal or legal assistant assigned to your case.

Can I send you the accident report or my medical bills?

No, we must receive those directly from your attorney’s office.

If I already received an advance, can I get another one?

Yes, we can always re-evaluate your case for an additional advance. We frequently do.

Do you have any other fees other than the interest charge?

Yes, if you want the check there tomorrow, we can overnight it to your attorney’s office for $50. We can always send your check regular mail, but we can’t guarantee how long it will take to get there. 888-508-4338.

Do I have to sign anything to get a pre-settlement advance on my lawsuit?

Yes, if you are approved for lawsuit funding, we will send a contract to your attorney. Once both he and you have signed it, you will receive your check. We send both to your attorney’s office so you will have to get there to pick it up.

What do I need to do to get started?
